Terms of Service — Tomecast

Operated by Soundica. Effective 2026-06-23. Version 1.0.

These are the Terms of Service for the Tomecast application (the "App"), distributed on Google Play (smartphone and tablet), Google Play Cars (Android Automotive OS), and the Appning by FORVIA AOSP head-unit store. By installing or using the App you agree to these Terms. If you do not agree, please do not install or use the App.

1. The service

Tomecast is a free, no-account, no-server player and directory of classic public-domain audiobooks. The App lists public-domain audiobooks and their chapters, and the chapter audio streams directly from the Internet Archive (archive.org) content-delivery network, which hosts the underlying LibriVox recordings. Soundica does not host, rehost, copy, transcode, or proxy the audio. Discovery is via LibriVox's public catalogue and feeds together with the Internet Archive. There is no advertising, no subscription, and no in-app purchase.

2. Licence to use

Soundica grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial use, subject to these Terms and to Google Play's Terms of Service (or, for the Appning store, the FORVIA distribution terms). Soundica retains all intellectual-property rights in the App itself (the code, UI, assets, and brand).

4. Third-party content (no rehost, no proxy)

Book titles, author names, chapter listings, durations, and cover artwork are read from LibriVox's public catalogue and feeds and from the Internet Archive; chapter audio is streamed from the Internet Archive CDN that hosts the LibriVox recording. Tomecast does not host, rehost, copy, transcode, or proxy the audio — the App opens a connection from your device directly to the third-party host. Titles, author names, and artwork are presented for the limited purpose of identifying each book to the user (nominative use); the presentation is neutral and non-endorsing — Tomecast does not imply partnership, sponsorship, or any commercial relationship with LibriVox, the Internet Archive, or any narrator.

Availability of any book or chapter depends entirely on the Internet Archive that hosts it. The directory is a passive index of public-domain recordings that LibriVox and its volunteers have placed openly on the public internet.

5. Copyright statement

An audiobook carries two stacked layers of rights: the underlying literary work (the text, and any translation of it) and the specific recorded narration (a performance). Tomecast lists a recording only where both layers are clear of copyright in the jurisdictions where the App ships.

Every recording the App lists is a LibriVox recording released under the Creative Commons CC0 1.0 Universal Public Domain Dedication — free for commercial use and redistribution, with no attribution required — narrating a text that is in the public domain. LibriVox records only texts that are public domain in the United States, and guarantees only United States status; it does not warrant the status of either layer in any other country.

Public domain is territorial. The App is distributed in jurisdictions whose terms differ:

Because LibriVox's guarantee is US-only, Soundica's curation favours works whose author has been dead long enough for the underlying text to be public domain in the EU/UK, Korea, and India too — not merely US-public-domain by publication date. Modern published translations of non-English works are separately copyrighted, so only public-domain-era translations (or LibriVox volunteers' own translations) are used.

6. Geographic access and source restrictions

Most LibriVox audio on the Internet Archive is published openly to the public internet with no geographic restriction; under the CJEU's Svensson doctrine, linking to or streaming such content reaches no "new public" beyond the audience the source has already addressed. Where the Internet Archive applies any restriction to a particular item, Tomecast respects it and does not attempt to circumvent it; if the host refuses the request from your location, the App will surface the host's response. Tomecast does not provide tools to bypass geographic restrictions.

7. Designated copyright agent and notice-and-takedown

Tomecast acts as an information-location-tool service provider for the purpose of notice-and-takedown. If you are a rights holder and believe a book, chapter, or narration appearing in the directory infringes your rights, contact Soundica's designated copyright agent at admin@soundica.app with subject line "Copyright/DMCA — Tomecast". We will acknowledge promptly and, on verifying a valid claim, remove the item from the directory within 7 days.

For a notice under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512(d) (Information location tools), please include the elements required by § 512(c)(3): identification of the copyrighted work, identification of the material to be removed (the specific book or chapter and its source URL), your contact details, the good-faith statement, the accuracy certification, and the physical or electronic signature of the rights holder or authorised agent. Note that because Tomecast does not host the underlying audio, removal from the directory does not remove the Internet Archive's own copy; the rights holder may also wish to notify the Internet Archive or LibriVox.

Soundica maintains and enforces a repeat-infringer policy under § 512(i): sources that draw repeated valid infringement complaints are excluded from the directory. For the EU, Soundica acts as a hosting/conduit-style service for the purpose of the Digital Services Act (DSA) Art. 16 notice-and-action mechanism; notices may be sent to the same address and will receive a substantiated decision and information on appeal.

8. Content and suitability

Tomecast lists a general-audience catalogue of classic literary works. Book metadata, including any age guidance, comes from LibriVox's catalogue. Soundica does not pre-screen the content of individual works; availability and content are controlled by LibriVox and the Internet Archive, and the App's store listing carries the corresponding content rating.

9. Right of publicity and personality rights

Tomecast displays author names, narrator names, and cover artwork as supplied by LibriVox's catalogue and the Internet Archive, for the limited purpose of identifying the book. This is nominative use and does not imply endorsement, partnership, or any other commercial relationship. If you hold publicity or personality rights and believe a specific use is inappropriate, contact the address in Section 16.

10. Disclaimers and as-is

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Soundica does not warrant that the App, the discovery sources, or any specific book or chapter will be uninterrupted, error-free, or continuously available — discovery and audio are operated by third parties and may change, move, or become unavailable. In jurisdictions where certain statutory rights cannot be excluded (notably under EU and UK consumer-protection law and Singapore's Consumer Protection (Fair Trading) Act), those rights are unaffected.

11. Limitation of liability

To the maximum extent permitted by applicable law, Soundica's total liability arising out of or relating to the App is limited to the amount you paid for the App (which is zero). Soundica is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold Soundica harmless from any claim, demand, or damages arising out of your breach of these Terms or your violation of any law or third-party right.

13. Distracted driving (Android Automotive OS / Android Auto / Appning)

When used on an Android Automotive head unit, an Android Auto projection, or an Appning by FORVIA AOSP head unit, the App follows the distraction-free interaction model required by Google's Cars policy and the FORVIA portal: large touch targets, single-tap controls, glanceable layout, and parked-only settings panels. You remain solely responsible for driving safely and complying with all road rules in your jurisdiction; do not interact with the head unit when doing so would be unsafe or illegal.

14. Termination

You may stop using the App at any time by uninstalling it. Soundica may suspend or discontinue the App or any feature at any time, with or without notice. The licence in Section 2 terminates automatically on uninstall or discontinuation.

15. Changes to these Terms

Soundica may update these Terms from time to time. Material changes are reflected in an updated "Effective" date at the top. Continued use of the App after a change constitutes acceptance of the revised Terms.

17. Governing law and venue

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. If you are an EU or UK consumer, you may rely on mandatory provisions of the law of your country of residence. Disputes may be brought in the courts of Singapore, without prejudice to any non-waivable right you have to bring proceedings in the courts of your own jurisdiction.
