Terms of Service — Podlingo India

Operated by Soundica. Effective 2026-06-11. Version 1.0.

These are the Terms of Service for the Podlingo India application (the "App"), distributed on Google Play (smartphone and tablet), Google Play Cars (Android Automotive OS), and the Appning by FORVIA AOSP head-unit store. By installing or using the App you agree to these Terms. If you do not agree, please do not install or use the App.

1. The service

Podlingo India is a free, no-account, no-server podcast aggregator for India. The App lists the India podcast market's shows and their episodes across all of India's languages in one feed. Episode audio streams directly from each show's publisher CDN, never from Soundica. Discovery is via Apple Inc.'s public iTunes Search and Top-Charts endpoints (no API key required), with a public fallback directory (e.g. Podcast Index). There is no advertising, no subscription, and no in-app purchase.

2. Licence to use

Soundica grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial use, subject to these Terms and to Google Play's Terms of Service (or, for the Appning store, the FORVIA distribution terms). Soundica retains all intellectual-property rights in the App itself (the code, UI, assets, and brand).

3. Acceptable use

You agree not to:

4. Third-party content (no rehost, no ad-stripping)

Show titles, descriptions, episode lists, and cover artwork are read from each show's public RSS feed; episode audio is streamed from the publisher's own CDN as listed in the feed enclosure. Podlingo India does not host, rehost, copy, transcode, or proxy the audio, and does not strip, replace, or block the publisher's in-stream advertising. Show metadata and artwork are presented for the limited purpose of identifying each show to the user (nominative use); the presentation is neutral and non-endorsing — Podlingo India does not imply partnership, sponsorship, or any commercial relationship with any publisher.

Availability of any show or episode depends entirely on the third-party CDN that hosts it. The directory is a passive index of feeds that publishers have placed openly on the public internet.

5. Apple iTunes Search and fallback discovery

Podlingo India uses Apple Inc.'s public iTunes Search and Top-Charts endpoints to discover podcast feedUrls and the India top charts. This usage is consistent with the public, free, no-key nature of those endpoints and the way other podcast clients use them. Podlingo India is not affiliated with, sponsored by, or endorsed by Apple Inc., and does not display Apple "Promo Content" (song previews, album art, application icons) outside the contexts permitted by Apple's marketing guidelines. The App may fall back to a second public directory if Apple's endpoint is unavailable or throttled.

6. Geographic access and publisher restrictions

Most podcasts are published openly to the public internet with no geographic restriction; under the CJEU's Svensson doctrine, linking to or streaming such content reaches no "new public" beyond the audience the publisher has already addressed. Some shows are geo-restricted by their publisher. Podlingo India respects these restrictions and does not attempt to circumvent them; if a publisher's CDN refuses the request from your location, the App will surface the publisher's response. Podlingo India does not provide tools to bypass geographic restrictions.

7. Designated copyright agent and notice-and-takedown

Podlingo India acts as an information-location-tool service provider for the purpose of notice-and-takedown. If you are a rights holder and believe a show or episode appearing in the directory infringes your rights, contact Soundica's designated copyright agent at admin@soundica.app with subject line "Copyright/DMCA — Podlingo India". We will acknowledge promptly and, on verifying a valid claim, remove the show from the directory within 7 days. This mechanism also serves as the grievance channel contemplated by India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 for the limited intermediary function the App performs.

For a notice under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512(d) (Information location tools), please include the elements required by § 512(c)(3): identification of the copyrighted work, identification of the material to be removed (the specific show or episode and its feed URL), your contact details, the good-faith statement, the accuracy certification, and the physical or electronic signature of the rights holder or authorised agent. Note that because Podlingo India does not host the underlying audio, removal from the directory does not remove the publisher's own copy; the rights holder may also wish to notify the publisher or their hosting service.

Soundica maintains and enforces a repeat-infringer policy under § 512(i): sources that draw repeated valid infringement complaints are excluded from the directory. For the EU, Soundica acts as a hosting/conduit-style service for the purpose of the Digital Services Act (DSA) Art. 16 notice-and-action mechanism; notices may be sent to the same address and will receive a substantiated decision and information on appeal.

8. Explicit content

Show metadata, including any "explicit" flags, comes from each publisher's own feed. Soundica does not pre-screen episode content; availability and content of individual shows are controlled by their publishers, and the App's store listing carries the corresponding content rating.

9. Right of publicity and personality rights

Podlingo India displays show titles, host names, and cover artwork as supplied in each show's public RSS feed, for the limited purpose of identifying the show. This is nominative use and does not imply endorsement, partnership, or any other commercial relationship. If you hold publicity or personality rights and believe a specific use is inappropriate, contact the address in Section 16.

10. Disclaimers and as-is

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Soundica does not warrant that the App, the discovery endpoints, or any specific show or episode will be uninterrupted, error-free, or continuously available — discovery and audio are operated by third parties and may change, move, or become unavailable. In jurisdictions where certain statutory rights cannot be excluded (notably under EU and UK consumer-protection law, the Indian Consumer Protection Act 2019, and Singapore's Consumer Protection (Fair Trading) Act), those rights are unaffected.

11. Limitation of liability

To the maximum extent permitted by applicable law, Soundica's total liability arising out of or relating to the App is limited to the amount you paid for the App (which is zero). Soundica is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold Soundica harmless from any claim, demand, or damages arising out of your breach of these Terms or your violation of any law or third-party right.

13. Distracted driving (Android Automotive OS / Android Auto / Appning)

When used on an Android Automotive head unit, an Android Auto projection, or an Appning by FORVIA AOSP head unit, the App follows the distraction-free interaction model required by Google's Cars policy and the FORVIA portal: large touch targets, single-tap controls, glanceable layout, and parked-only settings panels. You remain solely responsible for driving safely and complying with all road rules in your jurisdiction; do not interact with the head unit when doing so would be unsafe or illegal.

14. Termination

You may stop using the App at any time by uninstalling it. Soundica may suspend or discontinue the App or any feature at any time, with or without notice. The licence in Section 2 terminates automatically on uninstall or discontinuation.

15. Changes to these Terms

Soundica may update these Terms from time to time. Material changes are reflected in an updated "Effective" date at the top. Continued use of the App after a change constitutes acceptance of the revised Terms.

16. Contact and designated copyright agent

General contact — Soundica: admin@soundica.app

Designated copyright / DMCA agent — admin@soundica.app (subject "Copyright/DMCA — Podlingo India").

17. Governing law and venue

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules. If you are an EU or UK consumer, or an Indian consumer with non-waivable rights under the Consumer Protection Act 2019, you may rely on mandatory provisions of the law of your country of residence. Disputes may be brought in the courts of Singapore, without prejudice to any non-waivable right you have to bring proceedings in the courts of your own jurisdiction.
